CBD packaging compliance: labels, child resistance and the 2026 hemp change
There is no single federal CBD packaging rule: FDA's position is that CBD cannot be sold as a dietary supplement or added to food, so most CBD label and packaging requirements come from the states where you sell. The federal definition of hemp also tightens on December 11, 2026, when finished products with more than 0.4 mg of total THC per container stop counting as hemp. Tria makes CBD, tincture and hemp cartons on 18pt SBS from 300 units, and child resistant mylar bags for edibles from 200 units.
This is packaging guidance, not legal advice. CBD sits in a gap between federal and state law, and the rules move. We reserve the panel space and lay out what you give us; what goes on the panel is yours and your counsel's to confirm.
The federal picture
FDA. FDA has concluded that CBD products are excluded from the dietary supplement definition and cannot be added to food sold in interstate commerce, and it has sent warning letters to companies making drug-type claims (FDA, cannabis and CBD). For packaging, that means no Supplement Facts panel styled to look like a dietary supplement, and no claims that the product treats, cures or prevents a condition.
FTC. Health claims in advertising and on packaging have to be backed by competent and reliable scientific evidence, and the FTC has acted against CBD sellers on exactly that point (FTC, health products compliance guidance). Keep the front panel to what the product is and what is in it.
The hemp definition. Public Law 119-37, enacted in November 2025, rewrites the federal definition of hemp to count total THC, including THCA, and caps finished hemp-derived products at 0.4 mg of total THC per container. H.R. 6500, signed in September 2026, moved most of that change, including the per-container cap, to December 11, 2026. The exclusion of cannabinoids that the plant cannot produce naturally still applies from November 12, 2026. A full-spectrum tincture or gummy line should check its numbers against the cap before ordering packaging for next year.
The state layer
States regulate hemp-derived CBD in very different ways, so we do not publish a state matrix. These are the elements state rules commonly ask for, and the ones to confirm for each state you sell in.
| Element | What to confirm | Panel planning |
|---|---|---|
| Lab results link | Whether a QR code or URL to the certificate of analysis is required, and for which batch | Reserve a square at least 0.75 inch for the code |
| Cannabinoid content | How CBD and total THC must be stated, per serving and per container | Side panel next to the ingredients |
| Warnings | Exact wording, for example on pregnancy or keeping out of reach of children | Back panel, sized to the type you are given |
| Child resistance | Whether edibles, tinctures or all products need it | Decides between a carton and a CR bag |
| Age and marketing limits | Rules on imagery that appeals to children | Check before illustration work starts |
| Batch and dates | Batch number and expiration date | A blank area for a sticker or an inkjet code |
Child resistance for CBD
CBD is not listed in the federal Poison Prevention Packaging Act regulations, so child resistance for CBD comes from state law where it applies, usually for edibles. For gummies and other edibles, the child resistant mylar bag has a zipper tested to 16 CFR 1700.20, with documentation available on request, from 200 units in 10 to 14 business days. For a tincture, child resistance comes from the dropper closure your bottle supplier provides, not from the carton around it.
Which carton for which product
| Product | Tria format | Minimum and lead time |
|---|---|---|
| Tincture in a slim dropper bottle | Tincture box, slim 18pt SBS carton | 300 units, 10 to 12 business days |
| Gummy jar, topical jar or a mixed range | CBD box, 18pt SBS sized to the container | 300 units, 10 to 12 business days |
| Hemp flower jar, hemp seed oil, hemp tea or pre-roll packs | Hemp product box | 300 units, 10 to 12 business days |
| Gummies or edibles needing child resistance | Child resistant mylar bag | 200 units, 10 to 14 business days |
| Loose flower needing odor control | Smell proof mylar bag, foil laminate | 200 units, 10 to 14 business days |
Our view on cartons for CBD: buy the panel space. A tincture label on a 1 ounce bottle cannot carry a lab code, a cannabinoid statement, warnings and directions at a size anyone can read. A carton gives you four panels for that and leaves the bottle label for the brand. We do not make bottles, jars or droppers; send us the container and we size the carton to it.

Questions people ask
Is there a federal CBD packaging law?
Not a single one. FDA's position is that CBD cannot be sold as a dietary supplement or added to food, and the FTC requires health claims to be backed by scientific evidence. Most specific CBD label requirements, such as lab result links and THC statements, come from state law.
What changes for CBD on December 11, 2026?
Under Public Law 119-37, as amended by H.R. 6500, most of the new federal hemp definition takes effect on December 11, 2026. From then, finished hemp-derived products with more than 0.4 mg of total THC per container no longer count as hemp under federal law. Products containing cannabinoids the plant cannot produce naturally lose hemp status from November 12, 2026.
Does CBD packaging have to be child resistant?
Federal child-resistant rules do not list CBD, so it depends on the state, and edibles are where states most often require it. For gummies, our child resistant mylar bag has a zipper tested to 16 CFR 1700.20. For a tincture, child resistance comes from the dropper closure, not the carton.
Should I choose a CBD box, a tincture box or a hemp box?
Choose the tincture box for a slim dropper bottle. Choose the CBD box for a gummy jar, a topical jar or a range of extract products in different containers. Choose the hemp product box for hemp itself, such as flower, seed oil, tea or pre-roll packs. All three are 18pt SBS from 300 units in 10 to 12 business days.
Can I print a Supplement Facts panel on a CBD product?
FDA does not treat CBD products as dietary supplements, so a Supplement Facts panel can imply a status the product does not have. Many brands use a plain facts or ingredients panel instead. Confirm the format your state accepts with counsel before printing.
